By purchasing the intooba Construction Kit, you agree that you have read, understand, and agree to the following terms. Adult supervision is required at all times when children are playing or constructing with the intooba Construction Kit. The kit is not suitable for children under the age of 5 years old. You agree to read any provided materials, product information, and directions in order to become informed about the usage of the intooba Construction Kit and ensure you and the children you are supervising (the “Children”) only use the intooba Construction Kit as directed.
You expressly agree that your use or the Children’s use, or inability to use, the intooba Construction Kit is at your sole risk. The intooba Construction Kit is (except as expressly stated by Blue Egg Advisory Group, LLC (herein referred to as “we”, “our” or “us”)) provided 'as is' and 'as available' for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.
In no case shall we, our directors, officers, employees, affiliates, agents, contractors, or suppliers be liable for any direct, indirect, incidental, punitive, special, or consequential damages of any kind, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your or the Children’s use of the intooba Construction Kit, or for any other claim related in any way to your or the Children’s use of the intooba Construction Kit. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.
In consideration for your or the Children’s use of the intooba Construction Kit, you hereby release and forever discharge us and our officers, directors, affiliates, agents, contractors, suppliers, and employees, jointly and severally from any and all actions, causes of actions, claims and demands for, upon or by reason of any damage, loss or injury, which hereafter may be sustained by using the intooba Construction Kit.
This Disclaimer and Waiver of Liability form extends and applies to, and covers and includes, all unknown, unforeseen, unanticipated and unsuspected injuries, damages, loss and liability and the consequences thereof, as well as those now disclosed and known to exist.
